SACAP 4th Term Council - Quorate status

The South African Council for the Architectural Profession (SACAP) is aware that there have been a number of speculations regarding the quorate status of the 4th Term Council.
There were 4th Term Council members that resigned or vacated their positions, leaving a number of vacant seats on Council.
Given this situation, Council has sought legal advice and was advised as follows:
Vacancies on the Council may remain unfilled.
- The Minister has the discretionary power to fill a vacancy.
- If the Minister opts not to fill a vacancy, the Council then continues to function with such members that are available for the unexpired duration of their term of office.
- Governance dictates that the decision of the majority of the remaining members of Council present at any meeting, constitutes the resolution of Council.
Therefore, as matters stand, the Council is currently functioning validly as a quorate Council.
